The Aftermath

Now that it's all over, I realize that things will be like this for a while. I'll keep getting discriminated against because I'm 1/8th black, and others will be under unfair laws like the Separate Car Act for a while. Although we got our arguments rejected at every court, we got our wish. People heard what we had to say, and now the idea is out in the public. Although it's not the ideal outcome, it's a start.

Inside the Supreme Court, there were the nine justices as normal, but hundreds of spectators. All of the justices were white men, sitting up on their white horse. Except for one of them, Justice Harlen. All the justices said that Louisiana didn't violate my 13th or 14th amendment rights, and basically rejected my arguments. Harlen was the only one who sided with me. He agreed that the civil rights act was illegal and unconstitutional and needs to be overturned.
After my loss in the criminal district court, I didn't put my tail between my legs and skulk. My lawyer picked up his papers and petitioned to be heard from the Louisiana Supreme Court.
It felt like deja vu, the court rejected our arguments again and said that Judge Ferguson's ruling should most certainly not overturned. Again they affirmed the constitutionality of the Separate Car Act. Furthermore, they stated that I refused to admit I was black. Again this was a lie, as I clearly said on the train on which this happened, "I have a black ancestor." Feeling rejected and fed up, we petitioned to be heard by the Supreme Court.

Arrested and Jailed


The first thing that happened after I was arrested and jailed, was; my case was taken to the Criminal District court in New Orleans. They found me guilty of not leaving the car for whites when I was asked to. The court also denied my claim that the Separate Car Act was unconstitutional. They said that Louisiana could regulate it's railroad company however they see fit as long as everyone got equal accommodations. This would be valid except that it's a blatant lie. There's no way that the cars for Blacks have the same "accommodations".

The Train


I woke up this morning, a bright and early Tuesday, and what I was planning on doing seemed absurd. Luckily, I'm only 1/8th black and they let me purchase a ticket for a first class car. I then sat in the white section, and yelled that "I have a black ancestor" and railroad officials who were in on our arrangement arrested and jailed me.
Now, this may seem like a stupid thing, but we planned out this whole scene to get the "Separate Car Act" talked about in court. We gathered a group of supporters to help us go though with this, and we got our wish, the "Separate Car Act" went to court.
